I started college in the pre-med program at Florida State University, then switched majors to and graduated with a psychology degree. During law school at “Ole Miss” (the nation’s oldest public law school), my favorite course was “torts,” the area of law helping people recover after injuries. After law school, my first position was with a personal injury law firm. I have practiced in that area ever since.
In the late 1980s I worked at one of the original billboard/TV law firms and was disappointed with the treatment of clients. I saw the need for a lawyer who would be resourceful and persistent and take the time to maximize the recovery for every client. All too often, I saw billboard/TV “plaintiffs mills” not doing the job of a real trial lawyer: the investigation into the full facts, talking to the client and hearing their story, doing the medical research to discover all the client’s injuries, monitoring the injured person’s care to make sure they were getting better. Instead I saw billboard/TV lawyers assigning “case managers” (actual ex-insurance adjusters who would treat the clients just like they did when they worked at the insurance companies), sending them to “clinics” where the specialty of the “doctor” (chiropractor) was making money and running up the bills for which the client was responsible, not ever going to trial or even when they rarely did, not fully preparing for trial, or worst of all, pressuring clients to settle cases when the insurance company was not making a fair offer. The billboard/TV lawyers simply want a quick settlement and move on to the other thousands of cases they get. They are still doing that today. I just couldn’t do it anymore and feel ethical.
